Assumption of the Risk and Waiver of Liability Relating to 

Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. I understand that COVID-19 has been confirmed throughout the United States, including cases within California and surrounding states.  I further understand that COVID-19 is extremely contagious and, although the state of medical knowledge is evolving, it is general believed that the virus is spread from person-to-person contact, by contact with contaminated surfaces and objects, and/or in the air. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.  Azzur Group, LLC cannot guarantee that you or anyone who attends tonight’s’ event will not become infected with COVID-19. 

By signing this agreement, I acknowledge, understand and agree that COVID-19 is extremely contagious and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by attending the event and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the event may result from the actions, omissions, or negligence of myself and others, including, but not limited to, other staff, vendors or attendees of the event.  I further understand and agree that despite reasonable efforts Azzur Group, LLC and any of its affiliates and representatives cannot prevent me from becoming exposed to, contracting, or spreading COVID-19 while attending the event.

I further acknowledge that for at least the past 14 days, (i) I have not experienced a fever (100º or higher), cough, shortness of breath, excessive tiredness, diarrhea, nausea, loss of smell, or other flu and cold like symptoms, and and (ii) I am not aware of being in close contact with anyone who has been a confirmed carrier of the COVID-19 virus.  

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself, illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my presence at today’s event. On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless Azzur Group, LLC, its affiliates, officers, managers, members, employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Azzur Group, LLC, its affiliates, officers, managers, members, employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after visiting the event.
